This comparative law study focuses on the legal grounds, conclusion and wording of the development contract, including formal requirements, privacy policies, notarial issues, contractual obligations and consequences of their non-performance. The practical importance of this study also derives from the presentation and evaluation of collaterals for the purchaser and different approaches towards the issue of a developer's insolvency in both legal systems. It is worth to emphasize that the developer agreement is a trusted and popular form of property acquisition both on the Polish and German market.
